If you do not agree to these Terms, or if you do not have such power, please do not use or participate in any of the functions provided by the Service. In cases where you agree to these Terms in lieu of the organization, you state and guarantee that you have the power to subject the organization to these Terms.
WhaTap Labs may choose to modify or discontinue the Services, including any portion of the Services as we update our offerings and add more features. WhaTap Labs may stop, suspend, or modify the Services at any time without prior notice to you.
WhaTap Labs may modify these Terms at any time by posting a revised version on the Site. By accessing the Site, you agree to the latest version of these Terms. Please check Site regularly to view our then-current Terms.
The WhaTap Labs Privacy Policy governs any of the personal information that you provide to WhaTap Labs.
In registering for the Services, you agree to provide true, accurate, current and complete information about yourself as prompted by our registration form. And you agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You agree not to create an account using a false identity or information. You agree not to create an account or use the Site if you have been previously removed or banned from WhaTap Labs. It is your responsibility to safeguard the login and password that you use to access the Site. You agree not to share your login and password with any third party, including not sharing your login amongst two or more users. You are responsible for any activity originating from your account, regardless of whether such activity is authorized by you. You should notify WhaTap Labs immediately of any unauthorized use of your account.
You understand that Site has to change. You acknowledge and agree that WhaTap Labs may update the Site with or without notifying you. You may need to update third-party software from time to time in order to use the Site.
Any free trial or other promotion that provides you with free access to Commercial Services must be used within the specified time of the trial. At the end of the trial period, your use of that Commercial Services will expire and any further use of such Commercial Services is prohibited unless you pay the applicable fees.
You may not copy, modify, host, sublicense or resell the Site. You may not use the Site in any manner that would result in an infringement, dilution, misappropriation or other violation of any intellectual property or proprietary rights of others. You are solely responsible for any content published or made available by you through the Services or Site. You may not use the Services or Site to transmit, store, display, distribute or otherwise make available content that is defamatory, libelous, threatening, harassing, abusive, hateful, deceptive, fraudulent, obscene, pornographic, indecent, harmful to minors. Without limiting the foregoing prohibitions, you may not use the Services or Site for any illegal purpose or in violation of any laws (including without limitation data, privacy, consumer protection, and export control laws).
Information describing the Services is accessible worldwide but this does not mean the Services or certain portions of the Services are available in your country. Whatap Labs will not be liable for any liability arising from your use of the Services (including your transmission of Data) over the internet or other network.
You represent that, in agreeing to, and performing under, these Terms, you are not violating, and will not violate, any governmental laws, rules, regulations or orders that are applicable to your use of the Site.
Any information provided by WhaTap Labs regarding potential future products, features, or functionality is intended to outline our general product direction and should not be relied upon by you in making a purchasing decision. Any information shared with you regarding potential future products is not a commitment, promise, or legal obligation to deliver any material, code, or functionality. The development, release, and timing of any future features or functionality described for our products remains at WhaTap Labs’ sole discretion and may be altered or withdrawn at any time without notice.
Technical support is only provided to users of Commercial Services based on your specific purchased Services.
The Services may contain links to third party websites or technology (“Third Party Technology”). WhaTap Labs does not endorse and is not responsible or liable for the products or services provided by such third parties. WhaTap Labs is not responsible for the operation or functionality of such Third Party Technology. You are solely responsible for your use of any Third Party Technology. In addition, we may provide you with software governed by an open source license. If there are provisions in those open source licenses that expressly conflict with these Terms, the relevant open source license terms will apply.
You agree to defend, indemnify and hold harmless WhaTap Labs, its employees from and against any and all claims, damages, obligations, losses, liabilities, costs, debt or expenses (including without limitation attorneys' fees) arising out of or related to any claim, suit, action or proceeding by a third party arising out of or relating to your use of the Site.
WhaTap Labs shall provide the Service as it is in its present form. WhaTap Labs and it’s employ do not provide guarantees or assertions with respect to the quality, capability, suitability for a certain purpose, or outcomes of the use of the Service or the reports. WhaTap Labs does not explicitly or implicitly guarantee that the Service will satisfy all the demands of the Customer, nor does it guarantee that the Service will be provided without being discontinued, on time, safe, and without error. It is further emphasized hereby that WhaTap Labs has not made a guarantee with respect to violations of intellectual property rights by this Service or the possibility of the sale of the Service.
This Agreement will be interpreted, construed and enforced in all respects in accordance with the law of the Republic of Korea, without reference to its choice of law principles. Any legal action or proceeding arising under or relating to this Agreement shall be brought exclusively in Seoul Central District Court located in Seoul, Korea, and the Parties expressly consent to personal jurisdiction and venue in those courts. Matters not specified in these Terms and Conditions, and the interpretation of these Terms and Conditions, shall be in accordance with applicable Acts and Subordinate Statutes, including the 「Act on the Consumer Protection in Electronic Commerce, Etc.」, 「Act on the Regulation of Terms and Conditions」, and 「Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.」. WhaTap Labs may, if necessary, establish a separate operational policy for the provision of the Service.
